After graduating from Syracuse Law School in 1988, Mr. Viencek (pronounced "Vin cek") worked for a law firm employed by a number of major insurance companies. There, he learned firsthand how insurance companies operate and defend personal injury cases.

In 1992, he opened his own law practice and has been representing exclusively plaintiffs (i.e., injured individuals) ever since. He has counseled and represented people in virtually every type of personal injury/major loss case including cases involving: auto injury, brain injuries, defective and dangerous conditions resulting in people falling and getting hurt, legal malpractice, medical malpractice, dental malpractice, dog bites, wrongful death, pharmaceutical drugs, drug overdoses, dangerous/defective products, job site injuries, negligent newborn deliveries, loss of vision, negligent security, school bullying, emotional distress, post traumatic stress syndrome, cruise line injuries, investment loss, mortgage fraud, etc.

In 1994, he began working with one of the very top Bankruptcy and Consumer Debt attorneys in New York. This lead to a partnership and offices throughout the state. He now has a cutting edge debt relief practice which focuses exclusively on helping people eliminate debt thru non-bankruptcy means, and turning the tables on those who engage in debt collection harassment.

Mr. Viencek is an outstanding lawyer. His ability to articulate a client's position and put it into words is second to none. Gifted with good judgment and a lot of wisdom, he has an uncanny ability to see things others miss.
 

Why Trust So Important

These days, people are inundated with advertising claims by attorneys. This is particularly true when it comes to injury representation (although debt relief ads are also on the rise). In the past 7 years, three personal injury attorneys who were big time advertisers in central and western New York have been suspended from the practice of law for:
 

  • "engaging in conduct involving dishonesty, fraud, deceit or misrepresentation";
                                                    and
  • "engaging in conduct that adversely reflects on [their] fitness as a lawyer"
     

Two of the three were also suspended for:

  • "engaging in conduct that is prejudicial to the administration of justice".

All it takes to advertise is money. Advertising claims can turn out to be, well, just that - claims.

Attorney Andrew Cappocia, who ran catchy television commercials across the state promising to help people get out of debt, was disbarred and sentenced to 15 years in prison in 2006 for bilking over 5,000 clients out of 23 million dollars.
 

Mr. Viencek's Reputation as a Trusted Voice®

Mr. Viencek has been a strong proponent of attorney advertising reform for years. He's written a number of articles on the subject, and is a charter member of the New York State Academy of Trial Lawyers, an organization dedicated to improving the image of the legal profession through advertising reform. Few things upset him as much as when a person is taken advantage of by another lawyer. He will not hesitate to institute disciplinary proceedings or file a legal malpractice claim against another lawyer. Early in his career, Mr. Viencek assisted a client with a disciplinary proceeding against a lawyer that resulted in the lawyer being disbarred from the practice of law in New York State.

On a number of occasions, Mr. Viencek has taken over the representation of a client, replacing the client's attorney because of inadequate representation and/or improper conduct by that attorney (e.g., the attorney was neglectful in the handling of the client's case; failed to disclose a conflict of interest; failed to inform the client of a legal claim; failed to timely file a lawsuit, etc.). Ask Mr. Viencek what accounts for the type of person and attorney he is, and he will say one thing - God. In 1984, he experienced a life changing encounter with Christ.
